LA VIDA ESCAPES – TERMS & CONDITIONS

1. Agency Role & Responsibility

La Vida Escapes (“Agency”) acts solely as an intermediary between you (“Client”) and the travel suppliers providing your accommodations, transportation, tours, cruises, and other travel services. All suppliers are independent entities and are responsible for their own performance. The Agency does not own, operate, or control any supplier.

The Agency is not liable for supplier acts, errors, omissions, delays, schedule changes, overbookings, cancellations, or any event outside our direct control.


2. Client Responsibilities

By booking travel through La Vida Escapes, you agree that you are responsible for:

  • Reviewing all travel documents for accuracy
  • Meeting all passport, visa, vaccination, and health requirements
  • Complying with all airline, cruise line, hotel, and destination rules
  • Providing accurate traveler information
  • Monitoring flight schedules and supplier communications
  • Purchasing travel insurance if desired

Failure to meet these requirements may result in denied boarding, additional costs, or travel disruptions.


3. Payments & Authorization

By providing your credit card information, you authorize La Vida Escapes and its suppliers to charge your card for travel services, including deposits, final payments, upgrades, and any additional charges approved by you.

You agree not to initiate a chargeback for any reason related to:

  • Supplier policies
  • Cancellation penalties
  • Dissatisfaction with supplier performance
  • Delays, schedule changes, or force majeure events

If a chargeback is initiated, you agree to reimburse La Vida Escapes for any losses, fees, or legal costs incurred.


4. Cancellations, Refunds & Supplier Penalties

La Vida Escapes does not charge a planning fee and does not impose agency cancellation fees at this time.

However, all suppliers have their own cancellation and refund policies, which you agree to follow. These may include:

  • Non‑refundable deposits
  • Non‑refundable airfare
  • Penalties that increase as travel dates approach
  • No refunds for no‑shows or unused services

Refunds, if any, are issued solely by the supplier, not by La Vida Escapes.


5. Travel Insurance

Travel insurance is strongly recommended to protect against:

  • Trip cancellation or interruption
  • Medical emergencies
  • Lost or delayed baggage
  • Supplier default
  • Weather events
  • Travel delays

If you decline insurance, you accept full financial responsibility for all losses.


6. Documentation Requirements

It is the Client’s responsibility to ensure all travelers have valid:

  • Passports (valid for at least 6 months beyond travel dates)
  • Visas (if required)
  • Entry forms, health declarations, or vaccination records

The Agency is not responsible for denied boarding or entry due to incomplete or invalid documentation.


7. Force Majeure

La Vida Escapes is not liable for any loss, delay, injury, or expense caused by events beyond our control, including but not limited to:

  • Weather
  • Natural disasters
  • Pandemics
  • Government actions
  • Labor strikes
  • Supplier bankruptcy
  • Acts of terrorism

These events may result in additional costs or changes to your itinerary.


8. Hold Harmless & Limitation of Liability

By booking travel through La Vida Escapes, you agree to release, indemnify, and hold harmless the Agency, its owners, and its agents from any liability for:

  • Supplier actions, errors, or omissions
  • Delays, cancellations, or schedule changes
  • Illness, injury, or death
  • Loss of personal property
  • Travel disruptions or additional expenses
  • Any event outside the Agency’s direct control

The Agency’s maximum liability shall never exceed the amount of commission earned on your booking.


9. Governing Law

This Agreement is governed by the laws of the State of Iowa.
Any disputes shall be resolved exclusively in Iowa courts.


10. Acceptance of Terms

By providing payment information, submitting a booking request, or approving a reservation, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
